NEOSHO, MO---According to state regulations, a development district may be operated by voting property owners if there are no residents living within the area. In 2010, when the board was elected, they were unaware of any persons living within the district.  After passing a half cent sales tax, they discovered the owner of the Neosho Inn was claiming the business to be his place of residence. Because of the mistake, MODOT and the T.D.D'S banking lenders are now forcing board members to prove the legitimacy of all of their transactions.
Legal representatives say this could take weeks and put planned projects on hold. Board members sought help from their legal counsel at the time the error was made, Gilmore and Bell.  However, the law firm now represents the city of Neosho and council members have refused to release the firm to provide services to the T.D.D.
