Two daycare owners accused of lewd acts with children are back in court today. Judge Alisha Littlefield dismissed three of eight charges against Delbert Boyd luper and his wife, Evelyn Luper. But Littlefield did not dismiss all the charges.
A total of eight charges remain for Delbert "Boyd" Luper including five previous charges and three recently filed charges. Evelyn Luper is now facing only two charges out of three. The third, and most significant according to her attorney, was dropped that was enabling child sexual abuse. Both Delbert and Evelyn appeared in court this afternoon before Judge Littlefield. One concern from the Luper`s attorney, Park MeDearis, surrounded the testimony of two child victims from the daycare. Medearis says one victim stated that she was not exposed to lewd acts by the Luper`s. But during the testimony, the court broke for lunch. MeDearis says a court appointed attorney watched over the children to make sure no one talked to them during the break. But the supervisor was called away and a d-a staff member then took over. When court resumed, the child stated a new version of the testimony.
Littlefield ruled that will be looked at in district court later. For now Delbert Luper`s bond is set at 160-thousand dollars. Evelyn`s bond is set at 40-thousand dollars. A preliminary hearing is set for July 7th.
